About this book

The American Judiciary is a book by Simeon E. Baldwin. The contents list names, among others, chapters on the English origin and early development of the American judiciary and the separation of the judicial power from the legislative and executive in American constitutions. The text says no colony set up a permanent supreme court with full appellate jurisdiction.

The text says New York had a court named Supreme, but its business was largely the trial of original causes. The text calls it one of the acute observations of Alexander Hamilton that under our American Constitutions judges are less to be relied on by one who is attacked by the government. The text says another, and a more fundamental one, is that the judges and lawyers stand more nearly on the same level both in public regard and official position.
