About this book

Crimes and Punishments, by James Anson Farrer, includes a new translation of Beccaria's Dei Delitti e delle Pene and was printed in London in 1880. The preface gives the reason for translating the work afresh: it is a classical work of its kind, and its interest is still far from merely historical. It adds that the work was translated into English long ago.

The translated treatise argues about the limits of those who judge. A penalty beyond the legal limit is the lawful penalty plus another one, so a magistrate cannot add to a penalty already decreed. The sovereign makes general laws but cannot judge whether a particular person has broken the social compact, which calls for a third person, a magistrate, to affirm or deny the facts. Another passage describes an older practice in which public safety was an object of gain and the judge acted as an advocate for the treasury rather than an impartial arbiter.
